User Agreement

Master User Agreement: Acceptance of Terms

 

This Master User Agreement constitutes a binding contract between you, the User, and Fly Free Travels. with regard to the use of various services that are provided by Fly Free Travels.

  • Fly Free Travels with its principal office at Office No.1, 2nd Floor, SCO 2417-18, Sector 22-c, Chandigarh -160022, provides various travel related services through its Website (www.flyfreetravels.com), retail outlets, mobile-cellular technology as well as through its call-center.
  • Fly Free Travels shall provide you (“User”) travel-related information, pricing, availability and reservations for airlines, hotels, railway, holiday packages, bus and car rentals across cities and rural areas throughout India (“Service/s or Fly Free Travels Services”). These Services may be availed by the User in India at any time during the year as is offered by various third party vendors like airlines, hotels, etc.(“Service Providers”).
  • This Master User Agreement(“Agreement”)is applicable to all Fly Free Travels Services. In addition to this Agreement and depending on the Services opted for by the User, the User shall be required to read and accept the relevant Terms and Conditions of Service(“TOS”) for each such Service, which may be updated or modified by Fly Free Travels from time to time. Such TOS shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail. Further, while availing the services from Fly Free Travels, the User agrees to be bound by the terms and conditions of the respective group entities/affiliates of Fly Free Travels who are providing the services to the User. In case of any conflict between the TOS hereof and those on the website/micro website of the respective entities, the TOS of the respective entities shall prevail.
  • Fly Free Travels Services are offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be posted on the Website from time to time. For the removal of doubts, it is clarified that availing of the Services by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not avail Fly Free Travels Services.
  •  Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, flights, hotel reservations, packages, etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Service Provider with whom the User elects to deal, including terms and conditions set forth in a Service Providers’ fare rules, contract of carriage or house rules.
  • Fly Free Travels at its sole discretion reserves the right not to accept any order placed by the User through the Website without assigning any reason thereof. Any contract to provide any service by Fly Free Travels is not complete until full money towards the service is received from the User and accepted by Fly Free Travels.

LIMITATION OF LIABILITY

  • Fly Free Travels has endeavored to ensure that all the information provided by it is correct, but Fly Free Travels neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information. Fly Free Travels makes no warranty, express or implied, concerning the Website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any User or any other person, arising out of or from the use of any such information.
  • To the extent Fly Free Travels acts only as a booking agent and facilitator of Services on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the User as regards the standards and rendering of services by the service providers. In no circumstances shall Fly Free Travels be liable for the services provided by the service provider.
  • Although Fly Free Travels makes reasonable commercial efforts to ensure that the description and content in the TOS and on each page of the Website is correct, it does not, however, take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any User due to any information contained herein.
  • Fly Free Travels is not the service provider and cannot therefore control or prevent changes in the published descriptions or representations, which are always based upon information provided by the service providers. Fly Free Travels acts only as a facilitator of Services and shall not be held liable for any changes, deficiencies, disputes, etc. related to the services being provided by Service Providers, including the matters related to delays in refunds or no refunds, of the fares and charges paid to Service Providers. All refunds to User/customer on account of cancellation of any tickets/services or otherwise shall be made subject to receipt of such refunds by Fly Free Travels from the respective Service Provider including Airlines.
  • The maximum liability on part of Fly Free Travels arising under any circumstances, in respect of any Services availed, shall be limited up to a maximum of the refund of total amount received from the User/customer for providing the services less any cancellation, refund or others charges, as may be applicable. In no case Fly Free Travels shall be liable for any consequential loss, damage or additional expense whatsoever. In no event Fly Free Travels shall be liable for any kind of refunds/returns of charges/fee/fares paid to Service Provider for rendering the services to User/customer.

TERMINATION/ACCESS RESTRICTION

  • Fly Free Travels reserves the right, in its sole discretion, to terminate the access to the website and the related services or any portion thereof at any time, without notice.

FEES PAYMENT

  • Fly Free Travels reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the Fly Free Travels Services. Fly Free Travels further reserves the right to alter any and all fees from time to time, without notice.
  • The User shall be liable to pay all applicable charges, fees, duties, taxes, levies and assessments for availing the Fly Free Travels Services.

USER’S OBLIGATION AND USER ACCOUNT

  • The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.
  •  To avail a Service through the Website, the User has and must continue to maintain at his sole cost: (a) all the necessary equipments including a computer and modem etc. to access the Website/avail Services; (b) own access to the World Wide Web. The User shall be responsible for accessing the Services and that access may involve third party fees including, airtime charges or internet service provider’s charges which are to be exclusively borne by the User.
  • The User also understands that the Services may include certain communications from Fly Free Travels as Service announcements and administrative messages. The User understands and agrees that the Services are provided on an “as is” basis and that Fly Free Travels does not assume any responsibility for deletions, mis-delivery or failure to store any User communications or personalized settings.
  • Registration of the User on the Website is optional. If the User opts to register himself on the Website, upon completion of the registration process, the User shall receive a user id and password. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, the User agrees not to use any other party’s under id and password for any purpose whatsoever without proper authorization from such party. You are responsible for the security of your password and for all transactions undertaken using your password through our service. The Password entered by you is transmitted in one- way encrypted form to our database and stored as such. Thus the Password will not be known even to Fly Free Travels. You confirm that you are the authorised holder of the credit card or the original account holder used in the transactions you make using the Fly Free Travels services. Fly free Travels will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/credit card number/account details number for using Fly Free Travels Services.
  • The User also agrees and undertakes to immediately notify Fly Free Travels of any unauthorized use of the User’s password or user id and to ensure that the user logs off at the end of each session at the website. Fly Free Travels shall not be responsible for any, direct or indirect, loss or damage arising out of the user’s failure to comply with this requirement.
  • The User also agrees to: (a) provide true, accurate and complete information about himself and his beneficiaries as prompted by the registration form (“Registration Data”) on the Website; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provide any information that is untrue, inaccurate, not current or incomplete or Fly Free Travels has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Fly Free Travels has the right to suspend or terminate the User’s registration and refuse any and all current or future use of the Website and/or any Service.
  •  Furthermore, the User grants Fly Free Travels the right to disclose to third parties Registration Data to the extent necessary for the purpose of carrying out the Services.

BREACH

  •  Without prejudice to the other remedies available to Fly Free Travels under this agreement, the TOS or under applicable law, Fly Free Travels may limit the User’s activity, or end the User’s listing, warn other users of the user’s actions, immediately temporarily/indefinitely suspend or terminate the user’s registration, and/or refuse to provide the user with access to the website if :
  1. the user is in breach of this agreement, the TOS and/or the documents it incorporates by reference;
  2. Fly Free Travels is unable to verify or authenticate any information provided by the user; or
  3. Fly Free Travels believes that the user’s actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or Fly Free Travels.

INDEMNIFICATION AND LIMITATION OF LIABILITY

  • The User agrees to indemnify, defend and hold harmless Fly Free Travels from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Fly free Travels that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this Agreement and/or the TOS.
  •  In no event shall Fly Free Travels, its officers, directors, employees, partners or vendors be liable to User, the Vendor or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not Fly Free Travels has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with User’s purchase of the services herein.

GOVERNING LAW

  • This agreement and each TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Chandigarh.

 

TERMS AND CONDITIONS FOR PRODUCTS NOT ‘SERVICED BY FLY FREE TRAVELS

  • These terms of service (hereinafter referred to as “Terms and Conditions”) between Fly Free Travels. (hereinafter referred to as “Fly Free Travels”) and the users of the Marketplace (hereinafter referred to as “User”) describe, inter alia, the terms of offer for availing services, purchase of services (hereinafter referred to as “Services”) provided by the third party service provider (hereinafter referred to as “Vendor”).
  • PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE AVAILING ANY SERVICES ON THE MARKETPLACE. ANY SERVICE AVAILED BY THE USER THROUGH THIS MARKETPLACE SHALL SIGNIFY USERS’ ACCEPTANCE OF THE TERMS & CONDITIONS AND SHALL BE LEGALLY BOUND BY THE SAME.
  • IN ADDITION TO THE FOREGOING, USER SHALL ALSO BE BOUND BY ADDITIONAL TERMS OF OFFER FOR SERVICE ISSUED BY THE VENDOR AT THE MARKETPLACE. IF THERE IS ANY CONFLICT BETWEEN THE TERMS & CONDITIONS OF THE MARKETPLACE AND THE ADDITIONAL VENDOR TERMS, THE ADDITIONAL TERMS SHALL TAKE PRECEDENCE IN RELATION TO THAT SERVICE.
  • IF THE USER DOES NOT AGREE WITH THE TERMS OF OFFER FOR SERVICE, HE /SHE MAY NOT ACCESS THE MARKETPLACE.
  • Our company facilitates booking and purchase of travel packages and other travel related services (“Service/s”) offered by various third-party service providers (“Vendor/s”)
  • Fly Free Travels only routes payments from Customers. Fly Free Travels does not guarantee payments to Vendors for amounts that have not been successfully received by Fly Free travels from Customers.
  • While Fly Free Travels endeavours to provide quality Services and accurate pricing information, typographical and other errors may occur. In the event that a Service is listed at an incorrect price or with incorrect information due to an error in pricing or Service information, Fly free Travels may, at its discretion, either contact User for instructions or cancel User’s booking and notify User of such cancellation.
  • Fly Free Travels is a facilitator for payment from User to the Vendor and Fly Free Travels obligation to pay the Vendor is conditional upon successful receipt of the associated payments from User. Fly Free Travels does not guarantee payments to Vendors for amounts that have not been successfully received by Fly free Travels from the User.

TRANSACTION CONFIRMATION

  • The total price payable will be communicated to the User by email or chat, call before making payment to the Vendor. Users are hereby informed that in case of a booking request being rejected by a Vendor (i.e. not confirmed by the applicable Vendor), any amounts collected by Fly Free Travels for such booking will be refunded to the User’s Account used for making the payments.
  • As a general rule, Fly Free Travels will remit the to the Vendor the applicable amount due once Fly Free Travels receives confirmation of a booking from the applicable Vendor. Total price may instead be collected as part payments, as per Vendor policy.

 

  1. FLIGHT TICKETS

TERMS OF THE AIRLINES

  • The airline tickets available through the Website are subject to the terms & conditions of the concerned airline, including but not limited to cancellation and refund policies.
  • Fly Free Travels merely acts as a facilitator to enable the User to book a flight ticket. The contract of service for utilization of the flight is always between the User and the concerned airline.
  • To the extent Fly Free Travels acts only as a booking agent and facilitator of Services on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the User as regards the standards and rendering of services by the service providers. In no circumstances shall Fly Free Travels be liable for the services provided by the service provider.
  • Also, Fly Free Travels is not the service provider and cannot therefore control or prevent changes in the published descriptions or representations, which are always based upon information provided by the service providers. Fly Free Travels acts only as a facilitator of Services and shall not be held liable for any changes, deficiencies, disputes, etc. related to the services being provided by Service Providers, including the matters related to delays in refunds or no refunds, of the fares and charges paid to Service Providers. All refunds to User/customer on account of cancellation of any tickets/services or otherwise shall be made subject to receipt of such refunds by Fly Free Travels from the respective Service Provider including Airlines.
  • Airlines retain the right to reschedule flight times, route, change or cancel flights or itineraries independent of and without prior intimation to Fly Free Travels. As a facilitator Fly Free Travels has no control or authority over the logistics of the airlines and therefore is not liable for any loss, direct or incidental, that a User may incur due to such change or cancellation of a flight.
  • Different tickets on the same airline may carry different restrictions or include different services and price.
  • The baggage allowance on given fare is as per the terms decided by the airline, and Fly Free Travels has no role to play in the same. Some of the fares shown in the booking flow are “hand baggage fares” which do not entitle the User for free check in baggage and therefore the User will be required to pay separately for check in baggage. The prices for adding check-in baggage to a booking may vary from airline to airline. The User is advised to contact the airlines for detailed costs.

PRICING

  • The total price charged usually includes base fare, applicable government taxes and convenience fee. Users are required to pay the entire amount prior to the confirmation of their booking(s). In the event the User does not pay the entire amount within 24 hour of the booking, Fly Free Travels reserves its right to cancel the booking without prior intimation before date of travel. User agrees to pay full price, all statutory taxes, surcharges, and fees, as applicable on the date of travel.
  • In case of non-refundable, non-voidable, group tickets, special fare ticket or fixed departure ticket, the entire amount will be charged upfront and there will be no cancellation or modification in the ticket will be allowed.

TRAVEL DOCUMENTS

  • It shall be the sole responsibility of the User to ensure they are in possession of valid travel documents such as identity proof, passport, visa (including transit visa) etc. to undertake the travel. User agrees that in case of inability to travel for not carrying valid travel documents, Fly Free Travels shall in no way be held liable.
  • User understands that the information (if any) provided by Fly Free Travels regarding the travel documents is only advisory in nature and can’t be considered conclusive. The User shall ensure checking the requirements of travel with the respective airlines of the respective jurisdictions the User may transit through or choose to visit.

VISA GUIDELINE

  • Please carry a valid visa for the country you will be visiting or transiting through.
  • Please check with the concerned airline or embassy for all visa requirements.

CHECK-IN TERMS

  • User should check with the airlines directly regarding the check-in timings. Usually, check-in begins 2 hours before departure for domestic flights, and 3 hours before departure for international flights.
  • User should carry valid identification proofs, passport, age proofs as may be required to prove the identity, nationality and age of the passengers travelling on a ticket, including infants.
  • Once a passenger is checked-in then ticket cannot be cancelled or voided from our end, passenger will have to contact airline directly to get any changes done in the booking. Fly Free Travels will not be held responsible for that.

USE OF FLIGHT SEGMENTS

  • In the event User does not embark on the onward journey, the entire PNR pertaining to that booking shall be automatically cancelled by the airline. In such a scenario Fly Free Travels has no control in the said process nor will be obligated to provide alternate bookings to the User. The cancellation penalty in such an event shall be as per the applicable airline rules.

CHANGES TO EXISTING BOOKING

  • Any changes that are made to any existing booking shall be subject to certain charges levied by the respective airline, apart from the service fee charged by Fly Free Travels.
  • The User shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking. However, depending on the airline’s policy and fare class, charges for changes or modifications to existing bookings may vary.
  • Once ticket is in airline control then Fly Free Travels won’t entertain any changes or cancellation by the customer.
  • In case a customer gets the changes in the ticket done directly by the airline in first instance then further changes in the booking will be done by the airline only and any request for changes in the booking will not be entertained.
  • If ticket is exchanged by the airline due to schedule change or cancellation of flight from airline end or any other reason then future changes or cancellation will be done by airline only. Fly Free Travels is not obliged to entertain any request made by passenger.
  • Any change request will be entertained only 72 hours prior to departure, within the aforesaid time passenger must contact directly to the airline.

REFUND

  • Refunds will be processed as per the airline fare rules and cancellation policy. Such refunds shall be subject to Fly Free Travels receiving the same from the airlines, vendor, or consolidator. However, the statutory taxes and service charges paid to Fly Free Travels at the time of booking is a non-refundable fee.
  • In case of no-show or unutilized bookings, User shall be required to make requests for any valid and applicable refunds, as per Vendors’ policies, within 90 days from the travel date. No refund would be payable for any requests made after the expiry of 90 days of travel date/ check-in as aforementioned and all unclaimed amounts for such no-show or unutilized bookings shall accordingly be deemed to have been forfeited.
  • The refund shall be processed within 30-45 working days from the date of the cancellation request, after receiving back to back refund from the concerned Vendor/Airline. Refund will be made in the same mode/passenger account only.
  • All cancellations made directly with the airline need to be intimated to Fly free Travels, in order to initiate the process of refund. The processing time for refunds may vary depending on the mode of payment, bank etc. The refund shall be processed after deducting the Fly Free Travels statutory taxes, service fee and other taxes if applicable.
  • The refund will be credited to the same account from which the payment was made. For example, if the User used a credit card, Fly Free Travels will make an appropriate charge reversal to the same credit card; like-wise if the User used a debit card, Fly free Travels will credit the money to the same debit card.
  • In the event of cancellation and refund of partially utilized tickets, upfront discount and promo code discount availed at the time of booking would be deducted from the refund amount.
  • No refund will be allowed in case of non-refundable, special fares, promo fares, group fares, fixed departures, or advance purchase tickets.
  • In event of cancellation of flight from airline end due to any operational reason or any other reason then any alternate solution or credit voucher or any refund will be provided by airline only. Fly Free Travels is not responsible in any of the aforesaid case and there will be no compensation provided from our end; airline will be solely responsible for that.
  • In event of cancellation done directly by the airline either through email or call or chat or any mode of communication it is subject to cancellation charges and service charges paid to Fly Free Travels.
  1. HOTELS

INFORMATION FROM THE HOTEL AND THE TERMS OF THE HOTEL

  • The hotel booking voucher which Fly Free Travels issues to a User is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can Fly Free Travels be held liable for failure on part of a hotel to accommodate the User with a confirmed booking, the standard of service or any insufficiency in the services, or any other service related issues at the hotel. The liability of Fly Free Travels in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of Fly Free Travels (subject to availability at that time), or refunding the booking amount (to the extent paid) to the User. Any other service-related issues should be directly resolved by the User with the hotel.
  • Hotels reserves the sole right of admission and Fly Free Travels has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. Fly Free Travels will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of Fly Free Travels. No refund would be applicable in case the hotel denies check-in under such circumstances.

RESPONSIBILITIES OF THE USER

  • The User would be liable to make good any damage(s) caused by any act of him/ her/ or their accompanying guests (willful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. Fly Free Travels would not, in any way, intervene in the same.
  • The primary guest must be at least 18 years old to be able to check into the hotel.
  • The User has to be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a User if a valid identity proof is not presented at the time of check-in.
  • Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.

ADDITIONAL CHARGES BY THE HOTEL

  • The booking amount paid by the User is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the User at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the User directly to the hotel.
  • Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year’s Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. Fly Free Travels will have no control over waiving the same.

ALL LINKED TERMS AND CONDITIONS HEREUNDER ARE ASSUMED TO BE READ, UNDERSTOOD AND AGREED BY USER.
